TOWNSHIP OF LAURENTIAN VALLEY
NOTICE OF REVISED APPLICATION FOR SUBDIVISION AND PUBLIC MEETING FOR SUBDIVISION AND NOTICE OF SECOND PUBLIC MEETING FOR CORRESPONDING ZONING BY-LAW AMENDMENT

In the matter of Sections 34, 51(20) (a) and (b), and 51(21) of the Planning Act, R.S.O. 1990, c.P. 13, as amended, the Corporation of the Township of Laurentian Valley hereby gives REVISED NOTICE OF THE FOLLOWING:

  1. An Application for the Approval of a plan of subdivision (County of Renfrew Application 47-T-10004).
  2. A Public Meeting regarding the proposed subdivision layout and a corresponding zoning by-law amendment (Township of Laurentian Valley Application File No. Z-2010-17) required to permit the proposed subdivision.

Public Meeting
A PUBLIC MEETING TO INFORM THE PUBLIC OF THE PROPOSED SUBDIVISION AND REVISED ZONING BY-LAW AMENDMENT WILL BE HELD ON TUESDAY APRIL 5th, 2011, AT 5:30 P.M., AT THE TOWNSHIP OF LAURENTIAN VALLEY MUNICIPAL OFFICE LOCATED AT 460 WITT ROAD, PEMBROKE, ON, K8A 6W5.

Location of Subject Lands
The County of Renfrew has received application No.47-T-10004 for approval of a plan of subdivision for the lands located on Traxton Way (currently a private right-of-way), within Part of Lots 11, 12 and 13, Concession 2, F.A.L., in the geographic Township of Pembroke, in the Township of Laurentian Valley and located abutting the Ottawa River, the CP Railway and Provincial Highway 148, as shown on the attached Key Map. The Township of Laurentian Valley has also received a corresponding application for Zoning By-law Amendment being File No. Z-2010-17 for the same lands, for which a second public meeting is being held to address revisions as described below.

Description of Applications
Plan of Subdivision
The proposed residential plan of subdivision contains 22 lots for single detached residential dwellings, along with Block 23 to be dedicated to the Township for future road purposes. The lots are to be serviced by individual private wells and septic systems. All the lots will be accessed by an internal road system which connects to Highway 148 and includes portions of the current Traxton Way. That portion of Traxton Way is proposed as a municipal road subject to final approval of the plan of subdivision, with remaining portions of Traxton Way, being part of Block 23, identified on the plan as future roadway. No direct access for any lot is proposed onto Highway 148 as a result of three 0.3 reserve which will be provided along common property lines with Highway 148. The County of Renfrew File No. for the proposed plan of subdivision is 47-T-10004.

Purpose and Effect of Zoning By-law Amendment (Revised) (Application File No. Z-2010-17)
The purpose of the proposed amendment is to rezone the subject lands to implement the recommendations of an Environmental Assessment Report and more specifically establish the extent of lands on which no development can occur, in order to more specifically recognize the location of lands that are part of the Hazley Bay/Lisk Bay Provincially Significant Wetland on the subject property. The amendment also establishes a development setback to ensure that there are no negative impacts on the wetland as a result of a proposed 22 lot, single detached residential subdivision development on adjacent lands. The proposed amendment has been revised from that which was considered at a previous public meeting, in order to recognize the location of an approved stormwater management pond and to clarify that development may occur on some lands within 120 metres of a PSW where no negative impacts on the wetland will occur.

The effect of the amendment is to rezone lands from Residential One (R1), Residential One-Exception Six (R1-E6) and Environmental Protection (EP) to Environmental Protection-Exception Eight (EP-E8) and from Residential One (R1) to Residential One-Exception Twenty Three (R1-E23). The amendment would establish an exception zone to recognize a 30 metre buffer around an existing cattail marsh on the property wherein no development is permitted, and to recognize a stormwater management pond as a permitted use in the EP-E8 zone. A new R1-E23 zone would be established to recognize that uses permitted in the R1 zone are permitted on lands zoned R1-E23, notwithstanding that they are within 120 metres of a PSW. A provision would also be added to the R1-E6 zone to recognize that uses permitted in the R1 zone are permitted on lands zoned R1-E6, notwithstanding that they are within 120 metres of a PSW.

If a person or public body does not make oral submissions at a public meeting, if one is held, or make written submissions to the County of Renfrew in respect of the proposed plan of subdivision before the approval authority (being the County) gives or refuses to give approval to the draft plan of subdivision, and/or if a person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Laurentian Valley in respect of the proposed Zoning By-law Amendment before the by-law is passed, the person or public body is not entitled to appeal the decision of the County of Renfrew and/or the Township of Laurentian Valley, to the Ontario Municipal Board.

If a person or public body does not make oral submissions at a public meeting, if one is held, or make written submissions to the County of Renfrew in respect of the proposed plan of subdivision before the approval authority gives or refuses to give approval to the draft plan of subdivision and/or if a person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Laurentian Valley in respect of the proposed Zoning By-law Amendment before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.

A COPY of the Proposed Zoning By-law Amendment, any additional information relating to the proposed revised Zoning By-law Amendment and some information regarding the proposed plan of subdivision, are all available for inspection during regular office hours at the Township Office at the address indicated below.
