NOTICE OF THE PASSING OF A ZONING BY-LAW BY
THE CORPORATION OF THE TOWNSHIP OF LAURENTIAN VALLEY

TAKE NOTICE that the Council of the Corporation of the Township of Laurentian Valley passed By-law No. 2010-07-037 on Tuesday August 31st, 2010, under Section 34 of the Planning Act, R.S.O. 1990, c.P.13.

PURPOSE, EFFECT AND LOCATION OF ZONING BY-LAW AMENDMENT (Application File No. Z-2010-12)
The purpose of the proposed amendment is to rezone the subject lands to to add a cheese factory as a permitted use on a portion of a 163.3 acre parcel of land which will continue to also be occupied by an existing farm known municipally as 3018 Stafford Third Line. As a result of comments received through the public consultation process and at the July 27th, 2010, public meeting, some revisions have been made to the proposal. The processing would be undertaken in a separate building from the retail outlet, and would be in an area that is closer to the barn than the mobile home. The existing mobile home known municipally as 7 Petermann Road would be converted to a retail outlet and office. The cheese factory use would also be capped at a maximum floor area size not to exceed 557.4 square metres. The effect of the amendment would be to rezone the subject lands from Agriculture (A) to Agriculture-Exception Eighteen (A-E18) to establish a special provision to add the requested use, and provided for the maximum floor area restriction.

The lands affected by the Amendment are known municipally as 3018 Stafford Third Line and 7 Petermann Road, and are within Part Lot 16, Concession 2, geographic Township of Stafford, in the Township of Laurentian Valley, as shown on the Key Map.

AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing no later than 4:30 pm. onTuesday the 21st day of September, 2010, a notice of appeal with the Clerk of the Corporation of the Township of Laurentian Valley, which must set out the reasons for the appeal and must be accompanied by the prescribed fee of $125.00 payable to the Minister of Finance by certified cheque or money order. The appeal must also be accompanied by the completed OMB appeal form. If you wish to appeal to the Ontario Municipal Board, a copy of an appeal form is available from the OMB website at www.omb.gov.on.ca or by contacting the Township.

Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

PLEASE NOTE that one of the purposes of the Planning Act is to provide for planning processes that are open, accessible, timely and efficient. Accordingly, all written submissions, documents, correspondence, e-mails or other communications (including your name and address) form part of the public record and will be disclosed/made available by the Township to such persons as the Township deems appropriate, including anyone requesting such information. Accordingly, in providing any such information, you shall be deemed to have consented to its use and disclosure as part of the planning process.
