FORM 1 TAKE NOTICE that the Council of the Corporation of the Township of Laurentian Valley passed By-law No. 2010-06-029 on the 15th day of June, 2010, under Sections 34, 39 and 39.1 of the Planning Act, R.S.O. 1990, C.p.13. PURPOSE, EFFECT AND LOCATION OF ZONING BY-LAW AMENDMENT (Application File No. Z-2010-10) It should be noted that while the first temporary use by-law for this structure had a ten year timeline, each subsequent temporary use by-law has a duration of three years. Upon the expiration of the three year period, Council may by by-law grant further periods of not more than three years each during which the temporary use may continue to be authorized. Alternatively, if in the future there is no longer a need for the original dwelling to be occupied in a manner similar to a garden suite, the building would be required to be converted to a use other than residential. The effect of the amendment is to extend the lapsing date in the provisions of the Rural-Exception Twenty-Two (RU-E22) zone to July 20th, 2013. The lands affected by the Amendment are located at 910 and 912 Walford Road, in Part 1, Plan 49R-7058, in Part Lots 15, Concession A, geographic Township of Alice, in the Township of Laurentian Valley, as shown on the Key Map. AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing no later than 4:30 pm on the 6th day of July, 2010, a notice of appeal with the Clerk of the Corporation of the Township of Laurentian Valley, which must set out the reasons for the appeal and must be accompanied by the prescribed fee of $125.00 payable to the Minister of Finance by certified cheque or money order. The appeal must also be accompanied by the completed OMB appeal form. If you wish to appeal to the Ontario Municipal Board, a copy of an appeal form is available from the OMB website at www.omb.gov.on.ca or by contacting the Township. Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party. PLEASE NOTE that one of the purposes of the Planning Act is to provide for planning processes that are open, accessible, timely and efficient. Accordingly, all written submissions, documents, correspondence, e-mails or other communications (including your name and address) form part of the public record and will be disclosed/made available by the Township to such persons as the Township deems appropriate, including anyone requesting such information. Accordingly, in providing any such information, you shall be deemed to have consented to its use and disclosure as part of the planning process.
