NOTICE OF THE PASSING OF A ZONING BY-LAW BY
THE CORPORATION OF THE TOWNSHIP OF LAURENTIAN VALLEY

TAKE NOTICE that the Council of the Corporation of the Township of Laurentian Valley passed By-law No. 2010-10-045 on the 19th day of October, 2010, under Section 34 of the Planning Act, R.S.O. 1990, c.P.13.

PURPOSE, EFFECT AND LOCATION OF ZONING BY-LAW AMENDMENT (Application File No. Z-2010-16)
The purpose of the proposed amendment is to rezone the subject lands to prohibit the construction of a residential dwelling and limit the permitted uses to agriculture uses on the proposed retained lot in an application for consent, and to permit a hobby farm on the proposed severed lot (39072 Highway 41) with a minimum lot area of (10 acres). The amendment is required as a condition of approval of County of Renfrew Application for Consent File No. B93/09. The effect of the amendment would be to rezone the proposed retained lot from Agriculture-Exception Six (A-E6) to Agriculture-Exception Nineteen (A-E19) and from Rural (RU) to Rural-Exception Fifty (RU-E50) to prohibit a single detached dwelling on the lands so zoned and to amend the Zoning By-law to delete the existing provisions of the A-E6 zone and replace them with a provision that recognizes the severed lot and permits its use for a hobby farm on a lot with a minimum lot area of 4.047 hectares.

The lands affected by the Amendment are currently part of a property known municipally as 39072 Highway 41 and are within Part Lot 14, Concession 4, geographic Township of Stafford, in the Township of Laurentian Valley, as shown on the Key Map.

A FULL COPY OF THE NOTICE AND COPIES of the proposed amendment, material provided under Section 34 (10.1) of the Planning Act and any additional information relating to the proposed Zoning By-law Amendment (Application File No. Z-2010-16), are available for inspection during regular office hours at the Township Office. Questions related to the application should be directed to Lauree Armstrong, Township Planner.

AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing no later than 4:30 pm on Tuesday the 9th day of November, 2010, a notice of appeal with the Clerk of the Corporation of the Township of Laurentian Valley, which must set out the reasons for the appeal and must be accompanied by the prescribed fee of $125.00 payable to the Minister of Finance by certified cheque or money order. The appeal must also be accompanied by the completed OMB appeal form. If you wish to appeal to the Ontario Municipal Board, a copy of an appeal form is available from the OMB website at www.omb.gov.on.ca or by contacting the Township.

Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

PLEASE NOTE that one of the purposes of the Planning Act is to provide for planning processes that are open, accessible, timely and efficient. Accordingly, all written submissions, documents, correspondence, e-mails or other communications (including your name and address) form part of the public record and will be disclosed/made available by the Township to such persons as the Township deems appropriate, including anyone requesting such information. Accordingly, in providing any such information, you shall be deemed to have consented to its use and disclosure as part of the planning process.

A COPY of the amendment and any additional information relating to the Zoning By-law Amendment is available for inspection during office hours at the Township Office. Any questions related to the By-law should be directed to Lauree Armstrong, Township Planner.
