TAKE NOTICE that the Council of the Corporation of the Township of Laurentian Valley passed By-law No. 2011-11- 047 on the 15th day of November, 2011, under Section 34 of the Planning Act, R.S.O. 1990, c.P.13. PURPOSE, EFFECT AND LOCATION OF ZONING BY-LAW AMENDMENT (Application File No. Z-2011-14) The purpose of the proposed amendment is to rezone the subject lands to allow for a future severance by recognizing the location of an existing dwelling on the retained lot and providing the opportunity for the construction of a new single detached dwelling on the severed lot through a reduced setback from a General Industrial (GM) zone at 631 Bruham Avenue (Brum’s Dairy Limited) . The current provisions of the R1 zone require a minimum interior side yard depth of 3.0 metres where the other side yard is an exterior side yard (along a street). There is also a General Provision which requires a minimum 60 metre setback for a new dwelling from lands in a GM Zone. A concurrent application for consent to sever a new lot has been filed with the County of Renfrew Land Division Committee. The proposed severance would create a new lot line where the existing house would be on a retained corner lot bounded by Bruham Avenue and Joe Street, and the severed lot would be a vacant interior lot with frontage on Joe Street. The effect of the amendment would be to rezone the subject lands from “Residential One (R1)” to “Residential One -Exception Twenty-Four (R1-E24)” and establish special provisions to provide for a reduced interior side yard width of 1.0 metre where the other side yard is an exterior side yard (corner lot) for the existing dwelling, and also allow for a minimum setback for a new dwelling of 39 metres from lands zoned GM. The lands affected by the Amendment are located at 632 Bruham Avenue, being Lots 203 and 204 Registered Plan 366, geographic Township of Stafford, in the Township of Laurentian Valley. AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing no later than the 6th of December, 2011, a notice of appeal with the Clerk of the Corporation of the Township of Laurentian Valley, which must set out the reasons for the appeal and must be accompanied by the prescribed fee of $125.00 payable to the Minister of Finance by certified cheque or money order. The appeal must also be accompanied by the completed OMB appeal form. If you wish to appeal to the Ontario Municipal Board, a copy of an appeal form is available from the OMB website at www.omb.gov.on.ca or by contacting the Township. Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
