PURPOSE, EFFECT AND LOCATION OF ZONING BY-LAW AMENDMENT (Application File No. Z-2010-04) The effect of this amendment is to rezone the subject lands from “Rural (RU)” to “Rural-Exception Forty Eight -temporary (RU-E48-t)” and to establish a “Rural-Exception Forty Eight-temporary (RU-E48-t)” zone with special provisions to recognize the subject property and to permit a garden suite as a temporary use, in addition to the existing uses and the uses permitted in the Rural (RU) zone. The temporary use by-law would have a duration of ten (10) years from the date of passing of the by-law. Upon the expiration of the ten year period, Council may by by-law grant further periods of not more than three years each during which the temporary use may continue to be authorized. At such time as the garden suite is no longer required or the temporary use by-law expires and is not extended, the garden suite is then to be removed from the property. The lands affected by the Amendment are located at 1606 B Line Road, in Part Lots 13 to 17, Concession B, geographic Township of Alice, in the Township of Laurentian Valley, as shown on the Key Map. AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing no later than the 11th day of May, 2010, a notice of appeal with the Clerk of the Corporation of the Township of Laurentian Valley, which must set out the reasons for the appeal and must be accompanied by the prescribed fee of $125.00 payable to the Minister of Finance by certified cheque or money order. The appeal must also be accompanied by the completed OMB appeal form. If you wish to appeal to the Ontario Municipal Board, a copy of an appeal form is available from the OMB website at www.omb.gov.on.ca or by contacting the Township. Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
