NOTICE OF THE PASSING OF A ZONING BY-LAW BY
THE CORPORATION OF THE TOWNSHIP OF LAURENTIAN VALLEY

TAKE NOTICE that the Council of the Corporation of the Township of Laurentian Valley passed By-law No. 2011-11- 046 on the 15th day of November, 2011, under Section 34 of the Planning Act, R.S.O. 1990, c.P.13.

PURPOSE, EFFECT AND LOCATION OF ZONING BY-LAW AMENDMENT (Application File No. Z-2011-13)
The purpose of this amendment is to provide for clarification and/or correction of a number of typographic, section numbering, and/or mapping errors or inconsistencies that have been encountered by Staff since the Comprehensive Zoning By-law 08-04-391 was passed on April 9, 2008.

The following provides a general summary of the effect of the changes:
– by adding a definitions for “MULTIPLE ATTACHED DWELLING”, “GARDEN SUITE”, “WILDERNESS CENTRE”
– by adding consistent language to refer to all financial offices or banks in all zones where they are permitted as “FINANCIAL INSTITUTION OR BANK” per the existing definition
– by adding a yard encroachment allowance for accessibility ramps
– to correct the street name reference in the R1-E10 zone
– by adding the omitted text to the clause for the DM2-E1 zone
– by correctly referring to a 3.0 metre lot frontage on an existing lot rather than a reduced yard setback in the R1-E7 zone
– by correcting the map schedule to fix several mislabeling errors that resulted in no apparent zone label being attached to a property or the zoning not coinciding with the property boundaries or the wrong zone label being incorrectly interpreted when the old zoning maps were consolidated. These changes are summarized as follows:
- correcting a map label switch and rezoning lands from A-E19 to A-E6 and from A-E6 to A-E19
- lands from EMR to RU in Part Lot 24, Conc. 2, geog. Twp. of Alice
- 1343 Pembroke St. W. and 1236 Pembroke St E. to be zoned HC
- portion of 1376 Pembroke St. E. to HC-E13 so whole property is in same zone
- 537 Achray Rd from RU-E37 to RU
- 2593 Greenwood Rd from RU to RU-E6
- 2379 Gorr Street to be zoned R2
- to add the R1 zone label to a missed block of lots at 563 Roy St., 612 Karen St., 618 Karen St. & 562 Hamilton St.
– by correcting legend zone labels and scale labels
– by correcting several incorrect section number cross-references and heading names in several zone categories

A key map has not been provided as many changes apply to the entire Township, such as changes to the General Provisions Section and numbering references, while others apply to site specific provisions. Where site specific amendments apply, notice is also being sent by regular mail to the specific property owners. Anyone wishing to view details of the housekeeping amendment is welcome to view the draft by-law at the Township Office or on the Township website at www.laurentianvalleytwsp.on.ca

AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing no later than the 7th of December, 2011, a notice of appeal with the Clerk of the Corporation of the Township of Laurentian Valley, which must set out the reasons for the appeal and must be accompanied by the prescribed fee of $125.00 payable to the Minister of Finance by certified cheque or money order. The appeal must also be accompanied by the completed OMB appeal form. If you wish to appeal to the Ontario Municipal Board, a copy of an appeal form is available from the OMB website at www.omb.gov.on.ca or by contacting the Township.

Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

PLEASE NOTE that one of the purposes of the Planning Act is to provide for planning processes that are open, accessible, timely and efficient. Accordingly, all written submissions, documents, correspondence, e-mails or other communications (including your name and address) form part of the public record and will be disclosed/made available by the Township to such persons as the Township deems appropriate, including anyone requesting such information. Accordingly, in providing any such information, you shall be deemed to have consented to its use and disclosure as part of the planning process.

A COPY of the amendment and any additional information relating to the Zoning By-law Amendment (Application File No. Z-2011-13) is available for inspection during office hours at the Township Office. Any questions related to the By-law should be directed to Lauree Armstrong, Township Planner.
