BEING A BY-LAW TO REGULATE PARKING ON OR OBSTRUCTION OF HIGHWAYS AND STREETS WITHIN THE TOWNSHIP OF LAURENTIAN VALLEY AND TO REPEAL BY-LAW NUMBER 62-01-99 OF THE (FORMER) TOWNSHIPS OF STAFFORD AND PEMBROKE AND BY-LAW NUMBER 72-400 OF THE (FORMER) TOWNSHIP OF ALICE & FRASER.
WHEREAS, Sub-paragraph 1 of Section 314(1) of the Municipal Act, R.S.O. 1990 c.m. 45 as amended authorizes a Municipality to enact a By-Law for the purpose of prohibiting or regulating the obstructing, encumbering, injuring or fouling of highways or bridges;
NOW THEREFORE, the Corporation of the Township of Laurentian Valley enacts as follows:
1.1 Interpretations and Definitions
- “Corporation” shall mean the Corporation of the Township of Laurentian Valley.
- “Park” as applied to a vehicle, shall mean to allow the same to remain stationary on the street, except when in obedience to traffic regulations, signs or signals, for a longer period of time that is actually required for the purpose of taking on or discharging passengers, loading or unloading merchandise or goods.
- “Person” shall mean every person, firm, co-partnership, association or corporation.
- "Private Roadway or Driveway" shall mean every way or place in private ownership and use for vehicle traffic by the owner and those having expressed or implied permission given from the owner but not by other persons.
- “Street” shall include a common and public highway, avenue, parkway, driveway, square, place, bridge, viaduct, trestle, designated and intended for, or used by the general public for the passage of vehicles.
2.1 Parking - General Regulations
Section 1.
- No person shall park a vehicle as to in any way partially block an entrance to a public or private entrance or driveway.
Section 2.
- No person shall park a vehicle within three (3) metres of a fire hydrant.
- No person shall park a vehicle on any bridge or in any subway or the approaches thereto.
- No person shall park a vehicle in such a position as to prevent the convenient removal of any other vehicle previously parked.
Section 3.
- No person shall park a vehicle on any street or portion of a street where “No Parking” signs are on display.
- The streets where “No Parking” signs are hereby authorized to be placed are described in Schedule "A" to this By-Law. The Council of the Corporation of the Township of Laurentian Valley shall, by resolution, have the authority to further designate any area, street or part of a street as an area where the provisions of Subsection (a)herein apply.
Section 4.
- No person shall park a vehicle on any part of a street, highway, or Municipal boulevard in such manner as to interfere with civic or Municipal services, such as snow plowing or the removal of snow and ice.
Section 5.
- No person shall place snow and/or ice on any part of a street, highway, or Municipal boulevard in such manner as to interfere with civic or Municipal services such as snow plowing or the removal of snow and ice.
Section 6.
- All sections of this By-Law shall be deemed to be separate and independent and invalidity of any section or provision hereof shall not affect the remaining sections.
Section 7.
- Any Police Officer or Provincial Offences Enforcement Officer is hereby authorized to remove or to cause to have removed from any part of a street, highway or Municipal boulevard, any vehicle, at the owner’s risk, which may be parked in violation of this By-Law and to impound the vehicle until the owner or responsible person pay to the Corporation of the Township of Laurentian Valley the towing charge. Payments of the towing charge shall be made in cash, to the authorized person on duty at the Laurentian Valley Township Office at 460 Witt Road, Pembroke Ontario and the authorized person shall place this money in a sealed envelope provided for this purpose. Should the owner of the vehicle or responsible person, not obtain the release of the vehicle within seven (7) days of the occurrence, the Corporation shall then have the right to take court action to reclaim the towing cost and court costs.
Section 8.
- Any person or persons guilty of an offence under any of the provisions of this By-Law shall, upon conviction, forfeit and pay the fine for such offence as provided for under Section 61 of The Provincial Offences Act.
Section 9.
- By-Law Number 62-01-99 of the (former) Townships of Stafford and Pembroke and By-Law Number 72-400 of the (former) Township of Alice & Fraser are hereby repealed effective as of the date the fines under Section 61 of The Provincial Offences Act for this By-Law are approved.
Section 10.
- A decision of a competent court that one or more provisions of this By-Law are invalid in whole or in part does not affect the validity, effectiveness or enforce ability of the other provisions or part of of provisions of this By-Law.
Section 11.
- This By-Law shall come into force on the final passing thereof.

- Roy Street on both sides of the street between Indian Court and Karen Street and Karen Street between Hamilton Street and Roy Street.
- Third Avenue on both sides of the street between Boundary Road and Stafford Street.
- Lorne Street between Third Avenue and C.N.R. Industrial Spur.
- All of Richardson Crescent.
- First Avenue on both sides from Boundary Road to Lorne Street.
- All of Mountain View Drive.
- All of Rankin Street.
