Disabled Parking By-law 03-03-167

BY-LAW NUMBER 03-03-167


BEING A BY-LAW TO PROVIDE FOR ON AND OFF STREET PARKING FOR DISABLED PERSONS. 


WHEREAS, Section 102 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended and Part II A of The Highway Traffic Act of Ontario provide for the establishing and regulating of on and off street parking for disabled persons by the Municipality 

AND WHEREAS, the Council has been requested to provide for the enforcement necessary to prevent the unauthorized use of disabled parking permits and designated parking spaces.
 
NOW THEREFORE, the Council of the Corporation of the Township of Laurentian Valley enacts as follows:
 
1.1    Title
  1. This By-Law shall be known and may be cited as “DISABLED PERSONS PARKING BY-LAW”.
1.1    INTERPRETATIONS AND DEFINITIONS
  1. “Corporation” shall mean the Corporation of the Township of Laurentian Valley.
     
  2. “Designated Parking Space” shall mean a parking space designated under this By-Law for the exclusive use of a vehicle displaying a permit in accordance with the requirements of The Highway Traffic Act of Ontario and the regulations thereunder and this By-Law.
     
  3. “Municipal or Private Property” shall mean any open area or portion of a structure, other than the street or the highway, intended for the temporary parking of vehicles and on which there are designated parking spaces, whether their use involves payment of a fee or otherwise.
     
  4. “Permit” shall mean a disabled persons parking permit issued under The Highway Traffic Act of Ontario or a permit, number plate or other marker or device issued by another jurisdiction and recognized under that Act.shall mean every way or place in private ownership and use for vehicle traffic by the owner and those having expressed or implied permission given from the owner but not by other persons.
     
3.1    DESIGNATED PARKING SPACES
  1. A designated parking space shall be distinctly indicated in accordance with the requirements of The Highway Traffic Act of Ontario and the regulations made thereunder.
     
  2. A designated parking space on municipal or private property shall have a width of not less than 4.4 metres.
4.1    RESTRICTIONS
  1. No person or organization shall:

    1. park a vehicle in a designated parking space, or,
       
    2. be entitled to the benefit of an exemption under this By-Law.
       
  2. Despite any other provisions in this By-Law, no person shall park a vehicle on a street or highway in such a manner as to interfere with the clearing of snow from the street or highway.
     
5.1    EXEMPTIONS
  1. Despite any other provisions of this By-Law, any vehicle on which or in which is displayed a permit in accordance with the requirements of The Highway Traffic Act of Ontario and the regulations made thereunder is exempt from Section 4.1.A of this By-Law.
6.1    ENFORCEMENT
  1. The provisions of this By-Law shall be enforced by the Township, it’s servants, workmen, employees or any of them.
7.1    OFFENCES
  1. Any person or persons guilty of an offence under any of the provisions of this By-Law shall, upon conviction, forfeit and pay the fine for such offence as provided for under Section 61 of The Provincial Offences Act.
8.1    SEVERABILITY
  1. A decision of a competent court that one or more provisions of this By-Law are invalid in whole or in part does not affect the validity, effectiveness or enforceability of the other provisions or part of provisions of this By-Law.
9.1 EFFECTIVE DATE
  1. This By-Law shall be deemed to take effect as of the date of passing.
